本协议（以下简称“协议”）由您（以下简称“用户”）与长沙智蒙体验科技有限公司（以下简称“我们”或“服务商”），就您使用无边协同白板APP（以下简称“APP”）的各项服务达成如下协议。无边协同白板APP是一款由长沙智蒙体验科技有限公司开发并运营的集手写、绘图、标注及团队协作于一体的画板类应用程序。请您在使用APP前仔细阅读本协议，一旦您开始使用APP，即表示您已充分理解并接受本协议的所有条款和条件，并愿意遵守本协议的各项规定。

一、服务内容

  1. 服务描述：我们为您提供一个集手写、绘图、标注及团队协作于一体的在线白板平台，您可以通过APP创建、编辑、保存、分享白板内容，包括但不限于文字、图形、图片、视频链接等，并支持多人实时协作功能。
  2. 功能使用：我们承诺提供稳定、安全、高效的服务，确保您能够正常使用APP的各项功能。同时，我们也保留对APP功能进行升级、优化、调整的权利，以不断提升用户体验。

二、用户账户

  1. 注册与登录：您需要通过有效的邮箱、手机号码或其他第三方账号完成注册，并设置密码以登录APP。我们建议您妥善保管账户信息，避免泄露给他人。
  2. 账户安全：您应对自己的账户信息保密，并对账户下发生的所有活动负责。如发现账户被盗用或有异常活动，请立即通知我们，我们将尽快采取措施协助您解决问题。

三、内容管理

  1. 内容所有权：您通过APP创建的所有白板内容（不包括使用APP内置模板或素材库的内容）的知识产权归您所有。您同意授权我们为提供服务之目的而使用、存储、传输这些内容，但我们不会将您的内容用于其他商业用途。
  2. 内容规范：您承诺不发布、传播违法、色情、暴力、恶意、侵权等内容。我们有权在不通知您的情况下，删除违规内容或暂停/终止服务。同时，我们也保留对违规用户进行处罚的权利，包括但不限于警告、限制功能使用、封禁账户等。

四、隐私保护

  1. 信息收集：为优化服务，我们可能会收集您的个人信息和使用数据，具体参见《隐私政策》。我们承诺严格按照相关法律法规及《隐私政策》的规定处理您的个人信息，确保您的隐私安全。
  2. 信息使用：我们将严格按照《隐私政策》处理您的个人信息，未经您同意，不会向第三方披露您的个人信息。同时，我们也保留在法律法规要求或为了维护公共利益的情况下，向相关部门提供您个人信息的权利。

五、服务中断与终止

  1. 服务中断：因系统故障、维护升级或不可抗力因素导致的服务中断，我们不承担责任。我们将尽力减少此类情况的发生，并提前通知您（如可行）。
  2. 服务终止：您有权随时停止使用APP，并可选择删除账户及所有相关数据。我们也有权在违反本协议、法律法规或出于运营需要时，单方面终止向您提供服务。同时，我们也保留在APP停止运营或关闭时，提前通知您并协助您备份数据的权利。

六、免责声明

  1. 技术风险：互联网环境复杂多变，我们无法保证APP服务的绝对稳定性和安全性。因技术原因导致的损失，我们不承担责任。但我们将尽力提升服务质量，确保您的使用体验。
  2. 第三方服务：APP可能链接到第三方服务或内容，我们对第三方服务的质量和安全性不承担责任。请您在使用第三方服务时，仔细阅读相关协议并谨慎操作。

七、争议解决

本协议的解释、效力及履行均适用中华人民共和国法律。因本协议引起的或与本协议有关的任何争议，双方应首先通过友好协商解决；协商不成时，任何一方均可向服务商所在地人民法院提起诉讼。

八、其他

  1. 协议修改：我们有权根据业务发展和法律法规变化修改本协议。修改后的协议将通过APP公告或邮件通知您。您继续使用APP即视为接受修改后的协议。如您不同意修改后的协议，请停止使用APP并删除相关账户及数据。
  2. 完整协议：本协议构成双方就APP服务达成的完整协议，取代之前所有的口头或书面沟通、理解或协议。如有任何疑问或争议，请优先参考本协议的相关规定。
  3. 联系我们：如您对本协议或APP服务有任何疑问或建议，请通过APP内的客服功能或官方网站上的联系方式与我们联系。我们将尽快回复并为您提供帮助。

User Service Agreement for Borderless Collaborative Whiteboard APP

Welcome to use Borderless Collaborative Whiteboard APP!
This Agreement (hereinafter referred to as the “Agreement”) is entered into by you (hereinafter referred to as the “User”) and Changsha Zhimeng Experience Technology Co., Ltd. (hereinafter referred to as “we” or “Service Provider”) regarding your use of the services of Borderless Collaborative Whiteboard APP (hereinafter referred to as the “APP”). Borderless Collaborative Whiteboard APP is a drawing board application developed and operated by Changsha Zhimeng Experience Technology Co., Ltd. that integrates handwriting, drawing, annotation and team collaboration. Please read this Agreement carefully before using the APP. Once you start using the APP, it means that you have fully understood and accepted all the terms and conditions of this Agreement and are willing to abide by the provisions of this Agreement.
I. Service Content

  1. Service Description: We provide you with an online whiteboard platform that integrates handwriting, drawing, annotation and team collaboration. You can create, edit, save and share whiteboard content through the APP, including but not limited to text, graphics, pictures, video links, etc., and support multi-person real-time collaboration functions.
  2. Functional use: We promise to provide stable, secure and efficient services to ensure that you can use the various functions of the APP normally. At the same time, we also reserve the right to upgrade, optimize and adjust the APP functions to continuously improve the user experience.
  3. User account
  4. Registration and login: You need to complete the registration through a valid email, mobile phone number or other third-party account, and set a password to log in to the APP. We recommend that you keep your account information properly to avoid leaking it to others.
  5. Account security: You should keep your account information confidential and be responsible for all activities that occur under your account. If you find that your account has been stolen or there is abnormal activity, please notify us immediately and we will take measures to help you solve the problem as soon as possible.
  6. Content management
  7. Content ownership: The intellectual property rights of all whiteboard content you create through the APP (excluding content using the built-in templates or material library of the APP) belong to you. You agree to authorize us to use, store and transmit these contents for the purpose of providing services, but we will not use your content for other commercial purposes.
  8. Content specifications: You promise not to publish or disseminate illegal, pornographic, violent, malicious, infringing and other content. We have the right to delete the illegal content or suspend/terminate the service without notifying you. At the same time, we also reserve the right to punish users who violate the rules, including but not limited to warnings, restricting the use of functions, and banning accounts.
    IV. Privacy Protection
  9. Information Collection: In order to optimize the service, we may collect your personal information and usage data, please refer to the “Privacy Policy” for details. We promise to handle your personal information in strict accordance with the relevant laws and regulations and the “Privacy Policy” to ensure your privacy security.
  10. Information Use: We will handle your personal information in strict accordance with the “Privacy Policy” and will not disclose your personal information to third parties without your consent. At the same time, we also reserve the right to provide your personal information to relevant departments when required by laws and regulations or in order to safeguard the public interest.
    V. Service Interruption and Termination
  11. Service Interruption: We are not responsible for service interruptions caused by system failures, maintenance upgrades or force majeure. We will try our best to reduce the occurrence of such situations and notify you in advance (if feasible).
  12. Service Termination: You have the right to stop using the APP at any time and can choose to delete your account and all related data. We also have the right to unilaterally terminate the provision of services to you in case of violation of this agreement, laws and regulations or for operational needs. At the same time, we also reserve the right to notify you in advance and assist you in backing up your data when the APP stops operating or closes.
    VI. Disclaimer
  13. Technical risks: The Internet environment is complex and changeable, and we cannot guarantee the absolute stability and security of the APP service. We are not responsible for losses caused by technical reasons. But we will try our best to improve the quality of service and ensure your user experience.
  14. Third-party services: The APP may link to third-party services or content, and we are not responsible for the quality and security of third-party services. Please read the relevant agreements carefully and operate with caution when using third-party services.
    VII. Dispute Resolution
    The interpretation, validity and performance of this Agreement shall be subject to the laws of the People’s Republic of China. Any disputes arising from or related to this Agreement shall be resolved by the parties through friendly negotiations first; if the negotiations fail, either party may file a lawsuit with the People’s Court where the service provider is located.
    VIII. Others
  15. Agreement modification: We have the right to modify this agreement according to business development and changes in laws and regulations. The modified agreement will be notified to you through APP announcements or emails. Your continued use of the APP is deemed to have accepted the modified agreement. If you do not agree to the modified agreement, please stop using the APP and delete the relevant accounts and data.
  16. Entire Agreement: This Agreement constitutes the entire agreement reached between the parties regarding the APP service and supersedes all previous oral or written communications, understandings or agreements. If you have any questions or disputes, please refer to the relevant provisions of this Agreement first.
  17. Contact Us: If you have any questions or suggestions about this Agreement or the APP service, please contact us through the customer service function in the APP or the contact information on the official website. We will respond and help you as soon as possible.
