This Service Agreement (hereinafter referred to as “Agreement”) is a legally binding agreement between you (hereinafter referred to as “User” or “You”) and us (hereinafter referred to as “We” or “Operator”) regarding your download, installation, and use of the Artuner mobile application (hereinafter referred to as “Application”) and related services.
Please carefully read the entire content of this agreement. When you download, install or use this application, it means that you have read, understood and agreed to accept all the terms of this agreement. If you do not agree to any terms of this agreement, please do not use this application.

Acceptance of the Agreement
1.1 This agreement shall come into effect upon your first download, installation, or use of this application.
1.2 Your use of this application, or your clicking on the “Agree”/”I have read and agreed” button, shall be deemed as your acceptance of this agreement.
1.3 If you use this application on behalf of an entity (such as a company or organization), you represent and warrant that you have the authority to accept this agreement on behalf of that entity.
Service Content
2.1 This application is a professional instrument tuning tool that provides the following core functions:
High precision tuning based on YIN pitch detection algorithm, supporting 22 types of instruments;
37 preset tuning options (including standard tuning and special tuning);
Three tuning views (waveform diagram, dashboard, strobe diagram);
Variable adjustment clip support (automatic adjustment for 1-12 products);
Reference sound playback function;
Automatic/manual tuning mode;
A4 reference tone calibration (432-444 Hz, professional version function);
Built in metronome (BPM 40-240, multiple metronomes and preset scenes);
Tuning history records;
Dark interface, left-hand mode and other auxiliary functions.
2.2 This application provides two service models: free version and professional version (subscription based). The free version can use basic tuning functions; The professional version unlocks advanced features such as A4 reference sound calibration and provides a better experience without ads.
2.3 We reserve the right to modify, suspend, or terminate part or all of the services at any time, but will notify users in advance through in app notifications or other means.
User account
3.1 This application does not require registration of an account to use the core tuning function.
3.2 If you use subscription services through your Apple ID, your subscription status is managed by the Apple App Store. You are responsible for ensuring that your Apple ID information is accurate and in a valid state.
3.3 You are fully responsible for all activities that occur through your device or account.
User behavior norms
You agree to comply with the following regulations when using this application:
Legitimate use: This application shall not be used for any illegal, fraudulent, or unauthorized purposes.
Reverse engineering is not allowed: This application shall not be reverse engineered, decompiled, disassembled, or otherwise attempted to obtain source code.
Do not interfere: Do not use any automated tools (such as crawlers, robots) to access or interfere with the normal operation of this application.
Do not spread malicious content: Do not spread viruses, malicious code, or other harmful content through this application or channels related to this application.
Respect intellectual property rights: Reproduction, modification, distribution, or creation of derivative works of this application is prohibited unless expressly authorized in writing by us.
Violation of the above regulations may result in immediate termination of your usage rights, and we reserve the right to pursue legal responsibility.
Intellectual Property
5.1 The intellectual property rights of this application and all its contents (including but not limited to software code, interface design, icons, text, algorithms, trademarks, etc.) belong to us or our authorized party and are protected by the Copyright Law of the People’s Republic of China, the Trademark Law, and relevant international treaties.
5.2 We grant you a limited, personal, non exclusive, non transferable, revocable license to install and use this application on Apple branded devices owned or controlled by you, for personal non-commercial purposes only.
5.3 This license does not imply the transfer of any ownership to you. You are not allowed to use this application for commercial purposes in any form (such as resale, rental, distribution to third parties, etc.), unless otherwise agreed in writing.
Subscription and Payment
6.1 Subscription Method
The professional version offers the following subscription options:
Annual subscription (including a 3-day free trial period)
Monthly subscription
Weekly subscription
Lifetime buyout
6.2 Subscription and automatic renewal
Subscription services are paid through the in app system of the Apple App Store.
Your subscription will be automatically renewed unless you turn off automatic renewal at least 24 hours before the end of the current subscription period.
The renewal fee will be deducted from your Apple ID account within 24 hours before the end of each subscription period.
You can manage or unsubscribe from your device in “Settings>Apple ID>Subscription”.
6.3 Free Trial
Annual subscription offers a 3-day free trial period. After the trial period ends, unless you cancel in advance, it will automatically be converted to a paid subscription and charged.
Each user is limited to one free trial.
6.4 Refund
All payments are processed through the Apple App Store. Please follow the refund policy of Apple App Store for refund matters. We are unable to process refund requests directly.
6.5 Price Changes
We reserve the right to adjust subscription prices. Price changes will be notified to you within the app or through the App Store. The price change does not affect your current paid subscription period, but will apply to subsequent renewals.
Disclaimer and Limitation of Liability
7.1 This application is provided on an “as is” and “as is” basis. To the maximum extent permitted by law, we do not provide any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non infringement, etc.
7.2 We make every effort to ensure the accuracy of tuning and application stability, but do not assume responsibility for the following situations:
Tuning deviation caused by device hardware failure, operating system issues, or external environmental interference;
Subscription verification delays or failures caused by network issues or Apple App Store system problems;
Service interruption caused by force majeure (such as natural disasters, wars, government actions, etc.);
Any indirect, incidental, special, or punitive damages.
7.3 In any case, our total compensation liability to you shall not exceed the total amount you have paid for this application in the past 12 months.
Changes to the Agreement
8.1 We have the right to revise this agreement from time to time as needed. The revised agreement will be published on this page and updated with the ‘Last Updated Date’.
8.2 If the agreement changes involve your significant rights or obligations, we will prominently notify you through in app pop ups, notifications, or emails.
8.3 If you continue to use this application after the changes take effect, it shall be deemed that you accept the revised agreement. If you do not agree with the changes, please stop using this application and uninstall it.
Termination of the Agreement
9.1 You may terminate this agreement at any time: You can terminate the application of this agreement to you by uninstalling this application.
9.2 We may terminate this agreement: If you violate any of the terms of this agreement, we reserve the right to immediately terminate this agreement, suspend or permanently terminate your access to this application without prior notice.
After the termination of the agreement, you should stop using this application and uninstall it. Termination does not affect any rights or obligations that have arisen prior to termination.
Governing Law and Dispute Resolution
10.1 The formation, validity, interpretation, performance, and dispute resolution of this agreement shall be governed by the laws of [your country/region].
10.2 Any disputes arising from or in connection with this Agreement shall first be resolved through friendly consultation between the parties. If the negotiation fails, either party may submit the dispute to the [People’s Court with jurisdiction in your location] for litigation resolution.
Third party beneficiaries
You confirm and agree that Apple Inc. and its affiliates are third-party beneficiaries of this agreement and have the right to enforce this agreement against you.
Separability
If any provision of this Agreement is deemed invalid or unenforceable, it shall not affect the validity of the other provisions, which shall remain in full force and effect.
Complete Agreement
This agreement (along with the privacy agreement of this application) constitutes the entire agreement between you and us regarding the use of this application, and supersedes all prior oral or written communications, statements, or agreements.

本服务协议（以下简称“本协议”）是您（以下简称“用户”或“您”）与我们（以下简称“我们”或“运营方”）之间就您下载、安装、使用 Artuner 移动应用程序（以下简称“本应用”）及相关服务所订立的具有法律约束力的协议。
请您仔细阅读本协议的全部内容。当您下载、安装或使用本应用时，即表示您已阅读、理解并同意接受本协议的全部条款。如您不同意本协议的任何条款，请勿使用本应用。
1. 协议的接受
1.1 本协议自您首次下载、安装或使用本应用时生效。
1.2 您使用本应用的行为，或您点击“同意”/“我已阅读并同意”按钮的行为，均视为您已接受本协议。
1.3 如果您代表一个实体（如公司、组织）使用本应用，您声明并保证您有权代表该实体接受本协议。
2. 服务内容
2.1 本应用是一款专业的乐器调音工具，提供以下核心功能：
基于 YIN 音高检测算法的高精度调音，支持 22 种乐器；
37 种预设调音选项（含标准调音及特殊调音）；
三种调音视图（波形图、仪表盘、频闪图）；
变调夹支持（1-12 品自动升调）；
参考音播放功能；
自动/手动调音模式；
A4 参考音校准（432-444 Hz，专业版功能）；
内置节拍器（BPM 40-240，多种节拍音和预设场景）；
调音历史记录；
暗色界面、左手模式等辅助功能。
2.2 本应用提供免费版和专业版（订阅制）两种服务模式。免费版可使用基础调音功能；专业版解锁 A4 参考音校准等高级功能，并提供无广告等更优体验。
2.3 我们保留随时修改、暂停或终止部分或全部服务的权利，但会提前通过应用内通知或其他方式告知用户。
3. 用户账号
3.1 本应用不强制要求注册账号即可使用核心调音功能。
3.2 如您使用通过 Apple ID 进行的订阅服务，您的订阅状态由苹果 App Store 管理。您有责任确保您的 Apple ID 信息准确且处于有效状态。
3.3 您对通过您的设备或账户发生的所有活动承担全部责任。
4. 用户行为规范
您同意在使用本应用时遵守以下规范：
合法使用：不得将本应用用于任何非法、欺诈或未经授权的目的。
不得逆向工程：不得对本应用进行反向工程、反编译、反汇编或以其他方式试图获取源代码。
不得干扰：不得使用任何自动化工具（如爬虫、机器人）访问或干扰本应用的正常运行。
不得传播恶意内容：不得通过本应用或与本应用相关的渠道传播病毒、恶意代码或其他有害内容。
尊重知识产权：不得复制、修改、分发或创建本应用的衍生作品，除非获得我们的明确书面授权。
违反上述规范可能导致您的使用权限被立即终止，且我们保留追究法律责任的权利。
5. 知识产权
5.1 本应用及其全部内容（包括但不限于软件代码、界面设计、图标、文字、算法、商标等）的知识产权归我们或我们的授权方所有，受《中华人民共和国著作权法》《商标法》及相关国际条约的保护。
5.2 我们授予您一项有限的、个人的、非独占的、不可转让的、可撤销的许可，允许您在您拥有或控制的 Apple 品牌设备上安装和使用本应用，仅限于个人非商业目的。
5.3 本许可不意味着向您转让任何所有权。您不得以任何形式将本应用用于商业目的（如转售、出租、分发给第三方等），除非另行签订书面协议。
6. 订阅与付费
6.1 订阅方式
专业版提供以下订阅选项：
年度订阅（含 3 天免费试用期）
月度订阅
周订阅
终身买断
6.2 订阅与自动续费
订阅服务通过苹果 App Store 的内购系统进行支付。
除非您在当前订阅期结束前至少 24 小时关闭自动续费，否则您的订阅将自动续费。
续费费用将在每个订阅期结束前 24 小时内从您的 Apple ID 账户扣除。
您可以在设备的“设置 > Apple ID > 订阅”中管理或取消订阅。
6.3 免费试用
年度订阅提供 3 天免费试用期。试用期结束后，除非您提前取消，否则将自动转为付费订阅并扣费。
每位用户仅限享受一次免费试用。
6.4 退款
所有付费通过苹果 App Store 处理。退款事宜请遵循苹果 App Store 的退款政策。我们无法直接处理退款请求。
6.5 价格变更
我们保留调整订阅价格的权利。价格变更将在应用内或通过 App Store 通知您。价格变更不影响您当前已付费的订阅周期，但将适用于后续续费。
7. 免责声明与责任限制
7.1 本应用按“现状”和“现有”基础提供。在法律允许的最大范围内，我们不提供任何明示或暗示的保证，包括但不限于适销性、特定用途适用性、不侵权等保证。
7.2 我们尽力确保调音准确性和应用稳定性，但不对以下情形承担责任：
因设备硬件故障、操作系统问题或外部环境干扰导致的调音偏差；
因网络问题、苹果 App Store 系统问题导致的订阅验证延迟或失败；
因不可抗力（如自然灾害、战争、政府行为等）导致的服务中断；
任何间接的、附带的、特殊的或惩罚性的损害赔偿。
7.3 在任何情况下，我们对您的全部赔偿责任总额不超过您在过去 12 个月内为本应用支付的总金额。
8. 协议的变更
8.1 我们有权根据需要不时修订本协议。修订后的协议将在本页面发布，并更新“最后更新日期”。
8.2 若协议变更涉及您的重大权利或义务，我们将通过应用内弹窗、通知或电子邮件等方式显著提示您。
8.3 您在变更生效后继续使用本应用，即视为您接受修订后的协议。如您不同意变更，请停止使用本应用并卸载。
9. 协议的终止
9.1 您可随时终止本协议：通过卸载本应用即可终止本协议对您的适用。
9.2 我们可终止本协议：如您违反本协议的任何条款，我们保留在不事先通知的情况下立即终止本协议、暂停或永久终止您对本应用的访问权限的权利。
9.3 协议终止后，您应停止使用本应用并卸载。终止不影响终止前已产生的任何权利或义务。
10. 管辖法律与争议解决
10.1 本协议的订立、效力、解释、履行及争议解决均适用[您所在国家/地区]的法律。
10.2 因本协议引起的或与本协议有关的任何争议，双方应首先通过友好协商解决。协商不成的，任何一方均可将争议提交至[您所在地有管辖权的人民法院]诉讼解决。
11. 第三方受益人
您确认并同意，苹果公司及其关联公司是本协议的第三方受益人，有权依据本协议对您强制执行。
12. 可分割性
如本协议的任何条款被认定为无效或不可执行，不影响其他条款的效力，其他条款仍应完全有效。
13. 完整协议
本协议（连同本应用的隐私协议）构成您与我们之间就本应用使用事宜的完整协议，取代此前所有的口头或书面沟通、陈述或协议。
